SHAWA GRILL — Terms of Service

Effective date: [TO BE PROVIDED BY OWNER — set on publication]

Last updated: 2026-10-20 (draft)

These Terms of Service ("Terms") are an agreement between you and SHAWA GRILL HALAL LLC ("SHAWA," "we," "us," or "our"), a Florida limited liability company with its principal address at 101 SW 1st Street, PH06, Dania Beach, FL 33004. They govern your use of the SHAWA GRILL ordering application and the website shawagrill.com (together, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service allows guests of the SHAWA GRILL restaurant to view the menu, place food and beverage orders by scanning a QR code at their table, and place orders for pickup ("to-go") or delivery where offered. Food and beverages are prepared and served by the operating restaurant, SHAWA GRILL HALAL LLC, which holds the applicable Florida food-service licenses (including DBPR License No. MFD2362310 for its mobile food dispensing vehicle).

2. Orders

An order is submitted when you confirm it in the Service and receive an order confirmation on screen. The restaurant may decline or cancel an order — for example, if an item is unavailable, the kitchen has closed, or the order appears fraudulent — and will notify you using the contact details you provided.
Menu items, descriptions, availability, and prices may change at any time. The price shown at checkout, including applicable taxes (currently calculated at 7% in the Service) and any delivery or service fees shown before you confirm, is the price for that order.
You are responsible for the accuracy of the information you enter, including your name, phone number, table number, and delivery address. We are not responsible for orders delayed or misdirected because of inaccurate information you provided.
Alcohol, if ever offered, is sold only to persons of legal drinking age with valid identification at handover; such sales are governed by the operating restaurant's licenses.

3. Payment

Payment is processed through our payment providers (including Clover, where applicable) or in person at the restaurant, as offered at checkout. We do not store full payment card numbers. By paying, you agree to the payment provider's terms as applicable. An order may require successful payment authorization before the kitchen begins preparation.

4. Cancellations and refunds

Before preparation begins: you may cancel an order by contacting the restaurant promptly; prepaid amounts for orders cancelled before preparation begins will be refunded to the original payment method.
After preparation begins: orders that have entered preparation generally cannot be cancelled or refunded, except where the restaurant made an error (wrong or missing items, or a quality issue reported to staff promptly), in which case the restaurant will, at its discretion, remake the item, replace it, or refund the affected items.
Refunds are issued to the original payment method and may take several business days to appear, depending on your bank and the payment processor.
To request a refund, contact the restaurant or email support@shawagrill.com (PLACEHOLDER — [TO BE PROVIDED BY OWNER]: monitored support email), providing your name, phone number, and order details.

5. Promotions, including the review promotion

Promotions, discount codes, and offers in the Service (each, a "Promo") are subject to the terms shown with the Promo, may be limited in time and quantity, have no cash value, and cannot be combined unless stated otherwise.
Reviews: we may invite you to leave a review of your visit on a public platform such as Google. Reviews are entirely voluntary, are never a condition for any discount or benefit, and must comply with the review platform's own policies.
We may suspend a Promo or a code in cases of suspected abuse or fraud.

6. Acceptable use

You agree not to: place fraudulent or fictitious orders; interfere with the Service or the restaurant's operations (including staff functions protected by staff PIN access); attempt to gain unauthorized access to the Service or its data; or use the Service in violation of any applicable law.

7. Intellectual property

The Service, including its software, design, text, graphics, and the SHAWA and SHAWA GRILL names and logos, is owned by SHAWA GRILL HALAL LLC or its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for ordering from the restaurant. No other rights are granted.

8. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Menu photographs and descriptions are illustrative. Allergen and ingredient information in the Service is provided as a convenience; guests with allergies or dietary restrictions must confirm with restaurant staff before ordering, and SHAWA is not responsible for reactions where staff were not informed.

9. Limitation of liability

To the maximum extent permitted by applicable law, SHAWA GRILL HALAL LLC and its affiliates, members, and staff will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the total amount you paid to us for the order giving rise to the claim, or $50 if no order is involved.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.

11. Changes

We may update these Terms from time to time. Updates will be posted at shawagrill.com with a new effective date. Continued use of the Service after an update constitutes acceptance of the updated Terms.
